Welcome to Fomego! The terms “we”, “us” and “our” refer to Fomego. Fomego operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Fomego is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

Section 1 - Access and Account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. To use the Services, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete. You are solely responsible for maintaining the security of your account credentials.

Section 2 - Our Custom Products

We specialize in custom, made-to-order products including T-shirts, sweatshirts, and pins. We have made every effort to provide an accurate representation of our products. However, please note that colors or product appearance may differ slightly due to your device settings and display configuration. As these items are produced specifically for you, each product is unique. We reserve the right to limit the quantities of any products we offer or discontinue any product at any time.

Section 3 - Orders and Cancellations

When you place an order, you are making an offer to purchase. Fomego reserves the right to accept or decline your order for any reason. Cancellation Window: Because our products are customized, you have a 12-hour grace period from the time of purchase to request a cancellation. Once an order enters the production phase (after 12 hours), we are unable to accommodate cancellation or modification requests as the materials have already been custom-printed for you.

Section 4 - Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed. Unless stated otherwise, posted prices do not include taxes, shipping, handling, or customs charges. You represent and warrant that you are authorized to use the payment method provided and that all charges incurred will be honored by your credit card company.

Section 5 - Shipping and Delivery

All delivery times are estimates and are not guaranteed. Fomego is not liable for shipping and delivery delays caused by carriers, customs processing, or events outside our control (force majeure). Once we transfer products to the carrier, title and risk of loss pass to you. Shipping fees are non-refundable once the item has been dispatched.

Section 6 - Return and Refund Policy

Your purchases are subject to return or exchange solely in accordance with our 14-day policy. Due to the made-to-order nature of our items, we only accept returns for manufacturing defects, incorrect items, or sizing errors caused by our production team. Claims must be submitted to cs@fomego.co within 14 days of delivery with photographic evidence. We do not offer refunds or exchanges for customer errors, such as selecting the wrong size, color, or providing incorrect customization text.

Section 7 - Intellectual Property

Our Services, including all trademarks, text, images, and designs, are owned by Fomego, its affiliates, or licensors and are protected by copyright and intellectual property laws. These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, modify, or distribute any material from the Services without our prior written consent.

Section 8 - Relationship With Shopify

Fomego is powered by Shopify. However, any sales and purchases you make are directly with Fomego. You acknowledge that Shopify is not responsible for any aspect of the sales, including any injury or loss resulting from purchased products. You expressly release Shopify from all claims arising from your transactions with Fomego.

Section 9 - Feedback and User Comments

If you submit reviews or feedback, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display such content. We reserve the right to remove any content we deem unlawful, offensive, or in violation of any party’s intellectual property.

Section 10 - Prohibited Uses

You may use the Services for lawful purposes only. You are prohibited from using the site to violate any regulations, infringe upon intellectual property rights, harass others, or transmit malicious code. We reserve the right to terminate your access for violating any of the prohibited uses.

To the fullest extent provided by law, Fomego and its partners shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services or any products procured. This includes, without limitation, lost profits, lost revenue, or replacement costs.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Missouri, United States. You consent to the jurisdiction of the courts located in the jurisdiction where Fomego is headquartered.
